1. About these terms
These Terms of Service ("Terms") govern your use of the Gigförmedlingen platform ("the Platform"), accessible at gigformedlingen.se. By creating an account or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
These Terms apply alongside the Privacy Policy, the Cookie Policy, the Provider Terms (for users who publish services), and the Payment Terms (which become effective when platform payments are activated). Where these Terms conflict with the Provider Terms or Payment Terms, the more specific terms apply for that part of the service.
2. Definitions
"Account" means a registered user profile on the Platform.
"Customer" means a registered user who posts service requests, contacts providers, or otherwise seeks services on the Platform.
"Early Access" means the current launch phase of the Platform, in which platform payments, identity verification, reviews, dispute handling, and other full-launch features are not yet activated.
"Listing" means a service offering published on the Platform by a Provider.
"Platform" means the Gigförmedlingen website, mobile experience, and related services.
"Provider" means a registered user who publishes Listings or otherwise offers services on the Platform.
"Request" means a service request posted by a Customer describing a need for services.
"Service" means the work performed by a Provider for a Customer.
"User" means any registered or unregistered person using the Platform.
3. Eligibility and accounts
You must be at least 13 years old to create an Account. Users under 18 may use the Platform only with the consent and supervision of a guardian, and Providers under 18 require guardian-proxy verification before publishing Listings. The full minor-protection rules are set out in the Terms for Minors.
You must provide accurate information when creating an Account and keep it up to date. You are responsible for keeping your login credentials secure and for all activity that occurs under your Account. You must notify us promptly if you suspect unauthorized access.
One person may operate one Account. Operating multiple Accounts to circumvent suspensions, manipulate visibility, or otherwise misuse the Platform is prohibited.
4. What the Platform does and does not do
The Platform connects Customers and Providers. The Platform makes Listings, Provider profiles, and Requests discoverable and provides communication and account features.
In Early Access, Customers and Providers contact each other directly using contact details made available through the Platform and agree on price, scope, and payment between themselves. The Platform does not currently process payments between users, hold funds in escrow, or mediate disputes about service delivery or payment.
Platform payments, identity verification, reviews, dispute handling, and refund processing are planned for a later version. When those features activate, the Payment Terms and any feature-specific terms become effective and supersede the corresponding Early Access behavior.
The Platform is not party to any contract between a Customer and a Provider. The Platform does not warrant that any Listing or Provider will meet a Customer's requirements, and does not warrant the truthfulness or completeness of any user-supplied content.
5. User obligations
You agree to use the Platform lawfully and in good faith. In particular, you agree:
- to provide accurate information in your profile, Listings, and Requests
- to communicate honestly and respectfully with other users
- to honor commitments you make to other users on or through the Platform
- to comply with all applicable Swedish and EU laws, including tax law, labor law, consumer protection law, and laws governing the specific service you offer or seek
- to obtain any licenses, permits, or insurance required to offer or perform the services in question
- to respect other users' privacy and not to use contact details for purposes unrelated to the request or Listing in question
You are solely responsible for the services you offer or seek, the agreements you make, and the obligations you fulfil.
6. Prohibited content and conduct
You may not use the Platform to publish, request, or facilitate:
- services or content that are unlawful in Sweden or the European Union
- services that require professional licensing without holding the license, or where the license-holder is not a party to the agreement
- sexual services, escort services, or any service of a sexual nature
- the sale of weapons, controlled substances, or other goods restricted under Swedish law
- services involving the care of minors by unverified adults outside contexts where guardian-proxy verification rules apply
- services that promote violence, harassment, discrimination, or extremism
- copyright infringement, including the reproduction or distribution of protected works without rights
- spam, phishing, or other deceptive content
- impersonation of another person, business, or public official

You may not use the Platform to:
- attempt to gain unauthorized access to accounts, data, or systems
- circumvent security, rate limits, content moderation, or feature gating
- scrape, mass-download, or otherwise extract Platform data outside its intended use
- transmit malware or other harmful code
- interfere with the operation of the Platform
7. Content you provide
You retain ownership of content you upload to the Platform, including Listing text, images, Request descriptions, and messages. By uploading content, you grant the Platform a non-exclusive, royalty-free, worldwide license to host, display, transmit, and otherwise use the content as necessary to operate the Platform and to make it available to other users for the intended purpose.
You represent that you have the right to upload the content and to grant this license, and that the content does not infringe the rights of any third party.
The Platform may remove content that violates these Terms, applicable law, or community standards. The Platform may suspend or terminate accounts that repeatedly violate these Terms.
8. Communication between users
In Early Access, users may contact each other directly using contact details displayed on Listings and proposals, and through Platform messaging features when available.
When you contact another user, you agree to:
- use the contact details only for the purpose stated in the Listing or Request
- communicate in a respectful, non-discriminatory manner
- not transmit unsolicited commercial communications outside the scope of the Listing or Request
- not collect, store, or share contact details for purposes unrelated to the agreement in question
9. Disputes between users
In Early Access, the Platform does not mediate disputes about service delivery, quality, or payment. Customers and Providers are responsible for resolving disagreements directly.
When platform-mediated dispute handling activates in a later version, separate dispute terms will apply. Until then, users are encouraged to:
- communicate clearly about expectations before agreeing to a service
- document agreed scope, price, and timing in writing
- contact the other party promptly when issues arise
- seek resolution through Sweden's standard consumer dispute and small claims processes if direct resolution fails
The Platform may, at its discretion, remove Listings, Requests, or accounts where users repeatedly fail to honor agreements or generate complaints, but the Platform does not arbitrate the underlying dispute.
10. Suspension and termination
You may close your Account at any time through your account settings or by contacting us via the contact page. When you close your Account, your Listings and Requests are removed from public view; data retention follows the Privacy Policy.
The Platform may suspend or terminate Accounts that:
- violate these Terms
- engage in fraudulent, deceptive, or harmful conduct
- create risk for other users or for the Platform
- fail to respond to required verification steps when those become applicable
In serious cases, we may terminate immediately. In other cases, we will give reasonable notice and an opportunity to remedy the issue where appropriate.
Upon termination, the licenses you grant under section 7 continue for content already shared with other users to the extent necessary for the Platform's operation and for users who relied on that content in good faith.
11. Liability
The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components, beyond what is required by mandatory law.
To the maximum extent permitted by law, the Platform is not liable for:
- the conduct, performance, or non-performance of any User
- the quality, legality, safety, or suitability of any service offered or performed
- any agreement between Customers and Providers
- indirect, consequential, or punitive damages
Nothing in these Terms limits our liability where liability cannot be excluded under mandatory Swedish or EU law, including liability for personal injury caused by negligence, fraud, or fraudulent misrepresentation.
12. Indemnity
You agree to indemnify the Platform against claims arising from your breach of these Terms, your violation of applicable law, your conduct toward other users, or your provision or use of services arranged through the Platform, except to the extent the claim arises from the Platform's own negligence or breach.
13. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we will give reasonable notice through the Platform, by email to the address associated with your Account, or both. Continued use of the Platform after the effective date of an updated version constitutes acceptance of the updated Terms.
If you do not accept the updated Terms, you may close your Account before the effective date of the changes.
14. Governing law and jurisdiction
These Terms are governed by Swedish law. Disputes between you and the Platform that cannot be resolved informally are subject to the jurisdiction of Swedish courts. This does not affect your mandatory consumer rights under Swedish or EU law, including the right to bring proceedings in your local court where applicable.
